District Judge Rules in County Water Rights Battle

State District Judge Shannon Bacon has rejected an application for an East Mountain developer to access more than 100 million gallons of groundwater.

The application, filed in 2009, has been opposed by Bernalillo County with both the State Engineers Office as well as in the district court case.

Aquifer Science has been working on behalf of Campbell Ranch, a proposed residential, commercial and recreational master development in far east Bernalillo County, to try and secure the water rights.

“This is a big victory for the East Mountains and water rights in general,” says District 5 County Commissioner Charlene Pyskoty. “Judge Bacon followed the law and in doing so is protecting the environment and the future of east mountain residents.”

Judge Bacon’s ruling comes following an 11-day trial in March of 2018.

An update on East Mountain water issues and the next steps to protecting the water supply will be discussed at a public meeting on Saturday, February 23, 2019 at the Vista Grande Community Center from 10 – 11:30 a.m. Guest speakers include County Attorney Ken Martinez and attorney Jeffery Albright.
